Knowing When and How to Apply for Medi-Cal - Applying for Med-Cal

Understanding the process of qualifying for Medi-Cal can be a trying ordeal. Medi-Cal rules and regulations are complex, tricky, and seemingly designed to frustrate the very individuals who Medi-Cal is designed to help.

As an Elder Law Attorney, we help people qualify for Medi-Cal and at the same time preserve their assets. Some of the questions we hear from our clients, who are concerned that qualifying for Medi-Cal will leave them with virtually nothing, are as follows:

• Can I protect my home from the state?
• How much of my income will I be allowed to keep?
• How can I reduce (or even eliminate) my nursing home bills?
• Will I be able to pass on an inheritance to my children?
• Is there a way for me to avoid the hassle of dealing with State agencies?
• My loved one is already in a nursing home...is it too late to qualify for benefits?

Before you apply for Medi-Cal, your asset and income levels should be reviewed to determine eligibility. If your assets show that you have more than the allowable amount, you may be advised to transfer certain assets to the well spouse or to others, or to spend-down the assets. These steps should be taken before applying for Medi-Cal. In addition, you will be advised on the steps that may be taken to protect the home from a Medi-Cal lien.

A Medi-Cal application requires a lot of paperwork and documentation. It is then submitted to the government processing system. We will advise on the strategies allowed within the regulations to qualify for Medi-Cal while safeguarding assets, and will prepare the Medi-Cal application for you.
